Developers appeal on Ingersoll in Niskayuna

Their successful suit stalled the project and led to state Supreme Court Judge Joseph Sise issuing an order on Sept. 17 throwing out the special use permit and sending Highbridge Development back to the drawing board.

In his eight-page decisions, Sise wrote: " the petition is granted and the determination granting Highbridge a special use permit with respect to the Stanford Crossings Project is annulled."

If Highbridge is successful in its appeal, Sise's decision could be overturned and construction of the project allowed under the existing special use permit. The high-stakes legal battle is expected to take months before the Appellate Division of state Supreme Court issues its ruling.""
