Vanessa E. Ortiz, 21, of Colonie has been charged with manslaughter in the second degree, a felony for shooting Jason L. McMillian, 22.

Police said Ortiz recklessly caused his death by pointing a Ruger .22 rifle at McMillian's head and shot him.

Colonie Police Lt. Robert Winn said it was a case of Ortiz mishandling the weapon but it was not during a dispute between McMillian and her.

"During that, she pointed the gun at him and pulled the trigger," Winn said. "The status of the weapon being loaded or not comes into question."

Winn added that the weapon was owned by McMillian.

According to the police report, the McMillian's brother, mother were in were in the house at the time of the shooting, and two children, with at least one being the victim's, according to Winn.

McMillian's body was removed from the house by the Albany County Coroner's office with an autopsy expected to be conducted later today.

McMillian was arrested and was arraigned in Colonie Justice Court this morning. She was remanded to the Albany County Correctional Facility without bail.

The case has been handed over to the Albany County District Attorney.
