A Malta man was arrested for felony DWI because of two prior convictions in the last 10 years, according to State Police.
On March 19, State Police received a call around 7:45 p.m. of a drunken driver in a gray Honda Civic on Route 9 in the Town of Malta. After locating the vehicle a few minutes later and witnessing a few vehicle and traffic violations, State Police performed a traffic stop and discovered the driver, Stephen J. Cherniske, 40, of Malta, to be intoxicated, according to police reports.
Cherniske had been convicted of DWI twice in the last 10 years and had an interlock device installed on his ignition, but had managed to circumvent the system, according to police reports.
Cherniske was arrested for DWI, a felony, aggravated operation, a felony, and circumventing an ignition interlock device, a misdemeanor. According to police reports, Cherniske refused a chemical breath test and after arraignment was remanded to Saratoga County Jail in lieu of $10,000 cash bail.
