Former Elks treasurer sentenced to jail, $100,000 restitution

Former Saratoga Elks Lodge No.161 Treasurer Frank Mihalek was sentenced to six months in jail, five years probation and restitution of $100,000 following his felony guilty plea in October, according to Saratoga County District Attorney James Murphy.

Mihalek is scheduled to report to the Saratoga County Jail on Monday, April 4, at 1 p.m. His attorney said he was due to have rotator cuff surgery on April 15 and the judge said he would still go to jail but could possibly be allowed a hearing to determine if surgery is a medical necessity or could be postponed until the completion of his term, according to Murphy.
